1. Information on how to claim and the offer forms part of these Terms and Conditions (“Conditions”). Participation in this promotion is deemed acceptance of these Conditions
2. Any costs associated with entering the promotion, are the responsibility of each claimant
3. Subject to clause 4, the promotional offer is only open to Australian residents currently residing in Australia who: (a) purchase a Participating Product during the Promotional Period from a participating retailer, (b) comply with all claim requirements, and (c) who do not in any way tamper with the claim process and/or the offer.
4. Employees of the Promoter, their immediate families, related companies, directors, management and agencies associated with this promotion are ineligible to claim.
5. For the purposes of these Conditions, the following definitions apply: (a) “Purchase” means payment in full for the Participating Product during the Promotional Period starting 7th September 2011 from a participating retailer. Purchase does not include: (i) rental payment plans with a term of less than 18 months; (ii) lay-buys or pre-orders made before the promotion start date; (iii) Commercial or business transactions involving the purchase of more than three (3) units total of Participating Products; (iv) purchases via eBay or similar online third party internet websites; (v) second hand products or (vi) purchases made in conjunction with any other LG offer (b) ‘Participating Product’ means one of the Participating Products specified below;

6. To be eligible for a refund: (a) the Participating Product must have been Purchased from a participating retailer; and (b) the Participating Product must have been used under normal household conditions and maintained according to the instructions supplied.
7. To claim a refund: (a) claimants must contact LG Customer Information Centre on 1300 LG CARE (54 2273) within 100 days of the purchase date in accordance with these conditions; (b) the Promoter will then send a claim form for claimants to complete in full and return along with proof of purchase details to establish that the Participating Product was Purchased from a participating retailer and is not subject to any hire purchase, lease, rental or other agreement, a result of which being that another party has an interest in or charge over the Participating Product; (c) claimants must make the Participating Product available for collection and the Promoter will then arrange to pick up the Participating Product from the claimants place of residence; (d) the Participating Product must be returned in its original packaging together with all accessories and the original proof of purchase documentation. The Participating Product and accessories must be undamaged and in proper working order. The Promoter reserves the right to verify that the above conditions are satisfied before sending a cheque equal to the amount of the purchase price shown on the claimant’s proof of purchase. The refund cheque may take up to 14 weeks from return of the Participating Product.
8. The Promoter shall have the absolute discretion to determine whether the above conditions have been satisfied entitling the claimant to a refund or not.
9. Except for any liability that cannot be excluded by law, the Promoter excludes all liability (including negligence), for any personal injury; or any loss or damage; whether direct, indirect, special or consequential, arising in any way out of the promotional offers due to any reason beyond the reasonable control of the Promoter.
10. Certain legislation may imply warranties or conditions or impose obligations upon the Promoter which cannot be, or may only be to a limited extent, excluded, restricted or modified. These Conditions must be read subject to those statutory provisions. These Conditions will not affect any statutory rights that a claimant may have.
11. By accepting the offer each claimant consents to the Promoter and/or participating retailer collecting their personal information and to this information being entered into a database. Each claimant consents to the Promoter and/or participating retailer storing their personal information on the Promoter and/or participating retailer’s database and the Promoter and/ or participating retailer using the information for future promotional, marketing and publicity purposes including contacting claimant in the future with information on special offers or provide claimant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter and/or participating retailer may share information with their Australian related companies and promotional partners who may contact claimants with special offers in this way. All personal information will be stored at the offices of the Promoter and/ or participating retailer in accordance with their respective privacy policies, (the Promoter’s can be found at www. lg.com.au). Any requests to access, update or correct any information should be directed to the Promoter and/or participating retailer (whichever is applicable).
