AGREEMENT
In using the AskLG Service (the “Service”), you agree to these terms of use.

SPONSORSHIP
The Service is sponsored by LG Electronics MobileComm U.S.A., Inc., 10101 Old Grove Road, San Diego, CA 92131 (“LG”).

COSTS
The Service is provided free by LG. No purchase or payment is required. The Service is NOT a subscription service. Message and Data Rates may be applied by your carrier depending on your carrier service plan. Please check your plan or call your carrier to be sure of all costs associated with the use of your wireless device.

THE SERVICE
The Service is provided to answer questions relating to San Diego. You can ask for local tips, information about transport, entertainment, sports, recreation, dining out and in general anything you’d like to know about San Diego. You can access the Service by texting the keyword “AskLG” followed by your question to the number 88202. You will receive one, and only one, reply message (the “Answer”) to each message that you send to the service number (the “Question”). You may text STOP to 88202 to opt out of the Service. For help in using the service, text “AskLG HELP” followed by your question to 88202.

CARRIERS
The service is accessible from all US wireless carriers, with the exception of MetroPCS.

DURATION
The Service begins at 12:00:01 a.m. EDT on 12/8/09 and ends at 11:59:59 p.m. EDT on 8/3/10.

LIMITATIONS
You must be aged 13 or over to use the Service.

The Service can only be accessed by text message to the Service number. You can not call the service number.

The Service can not be used for help in emergencies. The Service can not be used for commercial purposes.

In using the Service you must comply with all local, state, national or international law.  You must not send Questions that are defamatory, harassing, abusive, fraudulent, obscene, or that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any law.

The Service is provide “as is” without warranty of any kind, either express or implied.
The Service is operated by human agents, who endeavor to provide independent, useful and accurate information in response to your Questions. Answers are provided by LG in good faith, and recommendations are based on reputable sources. LG does not warranty the accuracy of any Answer, and is not liable for any loss or adverse consequences caused to you by any Product, Service or Service Provider referenced in Answers.

Answers will be sent as quickly as possible upon receipt of your Question, but LG does not guarantee a minimum response time.

LG reserves the right to not respond to any Question that it considers to fall outside the scope of the service, which is to provide helpful information about San Diego.

Users are limited to a maximum of fifty (50) Questions over the duration of the Service, and LG reserves the right increase or lower this limit at any time.


PRIVACY
In order to provide the Service, LG will receive your cell phone number and your question. No other personal information is collected.

Your California Privacy Rights (As provided by California Civil Code Section 1798.83): A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (“California customer”) is entitled to request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of personal information, upon receipt of a request by a California customer, the business is required to provide a list of all third parties to whom personal information was disclosed in the preceding calendar year, as well as a list of the categories of personal information that were disclosed.

However, under the law, a business is not required to provide the above-described lists if the business adopts and discloses to the public (in its privacy policy) a policy of not disclosing customer’s personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of personal information and providing a cost free means to exercise that right.
