The below LG.com Member Exclusive Rewards Program Terms and Conditions (“Terms”), together with the LG Terms of Use located at https://www.lg.com/us/legal (“LG Terms,” and collectively with the Terms, the “Agreement”), constitute a binding agreement between you and LG Electronics USA, Inc., that governs your participation in the LG.com Member Exclusive Rewards Program (the “Program”).

IF YOU DO NOT AGREE TO BE BOUND BY THE AGREEMENT, YOU MAY NOT PARTICIPATE IN THE PROGRAM.

These Terms are “Supplemental Terms” as defined in the LG Terms and are incorporated into the LG Terms by reference. In the event of any conflict or inconsistency between these Terms and the LG Terms, the provisions of these Terms shall govern and prevail.

PLEASE BE AWARE THAT BY PARTICIPATING IN THE PROGRAM, YOU AND LG AGREE TO RESOLVE DISPUTES THAT ARISE BETWEEN US, INCLUDING ANY DISPUTES RELATED TO THE PROGRAM AND ANY DISPUTES THAT AROSE OR WERE ASSERTED PRIOR TO THE EFFECTIVE DATE OF THESE TERMS, THROUGH BINDING AND FINAL ARBITRATION, PURSUANT TO THE ARBITRATION AGREEMENT CONTAINED IN SECTION 19 OF THE LG TERMS. UNLESS YOU OPT OUT OF THE ARBITRATION AGREEMENT: (1) YOU MAY NOT BE A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION OR PROCEEDING AND (2) YOU ARE WAIVING YOUR RIGHT TO PURSUE DISPUTES OR CLAIMS AND SEEK RELIEF IN A COURT OF LAW AND TO HAVE A JURY TRIAL.

1. PROGRAM OVERVIEW. The Program allows eligible individuals (“Participants”) with an active LG Account (“Account”) to earn rewards upon purchase of select products on LG.com. Rewards will be credited to the Participant’s Account and can be redeemed with future purchases of eligible products on LG.com.

2. ELIGIBILITY. By registering for an Account, you represent that you are (i) at least sixteen (16) years old; (ii) of legal age to form a binding contract; and (iii) not a person barred from participating in the Program under the laws of the United States, your place of residence or any other applicable jurisdiction. Rewards may only be earned and redeemed on purchases with shipping addresses located in the 50 United States and District of Columbia (excluding Puerto Rico and other territories).

3. REGISTRATION. To participate in the Program, you must register and maintain a free Account at https://www.lg.com. When you register an Account, you agree to (a) provide true, accurate, current and complete information about yourself (the “Registration Data”); and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. You are responsible for all activities that occur under your Account. If you provide any Registration Data that is untrue, inaccurate, not current or incomplete, or LG has reasonable grounds to suspect that any Registration Data you provide is untrue, inaccurate, not current or incomplete, LG has the right to suspend or terminate your Account and cancel or reclaim any accrued Rewards. You agree not to create an Account using a false identity or information. You agree not to create an Account or participate in the Program if you have been previously removed or banned by LG. LG reserves the right to disqualify any person whose participation in the Program and/or use of Rewards is determined by LG, in LG’s sole discretion, to violate applicable laws or regulations, constitute fraud, or fail to comply with the Agreement.

4. REWARDS.

a. Earning. Participants can earn Rewards through the purchase of eligible products on LG.com. Eligible products are subject to change, with or without notice. If purchase of a product is eligible to earn Rewards, a notice will be displayed on the product page on LG.com. Rewards can only be earned on purchases through LG.com. Rewards will not be issued for purchases of LG products through other sales channels. Rewards will be credited to Participants’ Accounts approximately thirty-five (35) days after conclusion of the applicable return period. To view your Rewards balance, log into your Account by visiting the following link: https://sso.us.lg.com/.
b. Redemption. Rewards can be redeemed toward the purchase of eligible products on LG.com when the participant is logged into their Account. The rewards are available to use for the purchase and its corresponding value to purchase may be displayed during check out. Exclusions apply and eligible products are subject to change, with or without notice. If Rewards can be redeemed with the purchase of a particular product, a notice will be displayed on the product page on LG.com and/or LG will notify Participants directly of product redemption eligibility. Rewards can only be redeemed on purchases through LG.com. Redeemed Rewards may be applied to product purchase price, taxes or shipping. In the event of a purchased product is properly returned consistent with the applicable terms of purchase, the Rewards will be restored to Participant’s Account.

5. REWARDS LIMITATIONS.

a. Rewards do not constitute property and have no cash value. Rewards may not be redeemed for cash, transferred, or assigned for any reason. The sale or transfer of Rewards is strictly prohibited and any Rewards that are sold or transferred shall be deemed void. Any Rewards remaining in a Participant’s Account if the Program is canceled will be forfeited without compensation.
b. Rewards expire five (5) calendar years after they are earned, on a continuous, rolling basis. (“Eligibility Period”) Rewards not redeemed during the Eligibility Period will be forfeited. Oldest Rewards will automatically be redeemed first.
c. Rewards may not be used toward the purchase of a subscription of products (e.g. refrigerator water filters).
d. Rewards may only be earned and redeemed on purchases with shipping addresses located in the 50 United States and District of Columbia (excluding Puerto Rico and other territories).

6. PROGRAM TERMINATION OR MODIFICATION. LG reserves the right, in its sole discretion, to modify, cancel, terminate, or suspend the Program or these Terms at any time, for any reason, and with or without notice. The most recent version of these Terms will be located on the Program website. Your continued participation in the Program shall constitute an affirmative acknowledgment of any amendment or modification to the Terms and your consent to abide and be bound by the Agreement as amended or modified.

7. EFFECT OF TERMINATION. At the discretion of LG, Rewards not redeemed prior to Program termination will remain available for use for the remainder of the Eligibility Period, provided that Participant maintains an Account.

8. PRIVACY. Personal information collected in connection with the Program will be handled in accordance with the LG Privacy Policy located at https://privacy.us.lg.com/policies.

9. TAXES. Participants are responsible for the payment of any and all taxes which may result from participation in the Program.

10. WARRANTY AND RELEASE.

a. By participating in the Program, Participants warrant and represent that all information they provide to LG or any agent acting on LG’s behalf is true and accurate, and that no information or documentation submitted by Participant to LG is false, fraudulent, inaccurate, forged, counterfeit or otherwise in violation of this Agreement or any law.
b. By participating in the Program, Participants agree to release and hold harmless LG, authorized LG distributors and brokers, and their respective parents, subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all liability, loss, or damages arising out of or in connection with the participation in the Program and the awarding and use of any Rewards. LG assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to the Program site or Accounts.

11. DISCLAIMER. THE PROGRAM, INCLUDING ACCOUNTS, REWARDS AND PROGRAM RELATED WEBPAGES, ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS. LG MAKES NO WARRANTY WITH REGARD TO THE PROGRAM, INCLUDING ACCOUNTS, REWARDS AND PROGRAM RELATED WEBPAGES; OR THAT THE PROGRAM, INCLUDING ACCOUNTS, REWARDS AND PROGRAM RELATED WEBPAGES, WILL MEET PARTICIPANTS’ REQUIREMENTS, BE ACCURATE OR ERROR FREE, OR THAT ACCESS WILL BE TIMELY OR UNINTERRUPTED.
