ELIGIBILITY: The Art of the Pixel Contest (the “Contest”) is not open to the general public and is restricted to students who are enrolled, as of the start of the Contest Period, at a participating school that received an invitation to participate (the “Participating School”) and are legal residents of the 50 United States, including the District of Columbia, age 17 or older at the time of entry. There will be no more than ten (10) Participating Schools. Void outside the U.S. and wherever else prohibited by law. Employees of LG Electronics USA, Inc. (the "Sponsor”) and its respective subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members of, and/or those living in the same household of each, are not eligible to enter. Contest is subject to all applicable federal, state and local laws and regulations.
CONTEST TIMING: The Contest begins at 12:00:01 AM Eastern Time (“ET”) on Sunday, June 1, 2014 and ends at 11:59:59 PM ET on Sunday, August 10, 2014 (the “Contest Period”) and consists of three (3) phases: the Contest Entry Phase, Public Voting Phase, and Judging Phase, as represented in the chart below. The Contest Administrator’s computer is the official timekeeping device for this Contest.

HOW TO ENTER: Eligible participants may enter the Contest by visiting www.LGUSA.com/LGSupportsTheArts (the “Contest Site”), completing the entry form in its entirety, including your name, Participating School, email address, mailing address and phone number, and uploading your original work of digital art in either still format or moving image format (the “Digital Artwork”) and an artist statement explaining your Digital Artwork (the “Artist Statement”) (the “Contest Entry”). If submitting a moving image as Digital Artwork, participant must also submit a still frame of their Digital Artwork with their Contest Entry. There is a limit of one (1) entry per person.
The Digital Artwork must fit the following specifications:
- Must be new media work (either still or moving image);
- Must be one of the following types:
- If 1080p resolution, moving image;
- If 4K resolution, digital still or moving image
- Must be in MP4 or JPEG file format
- When submitting still images, Artwork must be 4K UHD and a resolution of 3840 pixels x 2160;
- When submitting motion artwork, must be a minimum of 1080p, or 4K;
- Content loop can be no longer than :90 seconds, if applicable; and
- Must have “landscape orientation/aspect ratio (16:9), resolution 1080p.
- Submission must be accompanied by thumbnail of digital artwork, if still image size should be 1200x1200 pixels and if submission is moving image, must be accompanied by a scaled down version not exceeding 2MB in size.
The Artist Statement may not exceed 250 words and should speak to why the OLED or 4K technology chosen makes for ideal canvas for art.
Entries must be received between 12:00:01 AM on Sunday, June 1, 2014 and 11:59:59 PM on Sunday, July 13, 2014. Incomplete entries will not be accepted and are void.
The Sponsor will review all submitted Entries and reserves the right in their sole and absolute discretion to reject, disqualify and/or remove any Entry that violates these Official Rules without any notification or warning. All approved Entries will be posted to a public gallery within the Contest Site (the “Contest Gallery”). Sponsor does not guarantee the posting of any entry.
All of the terms and conditions as described herein apply to the format of the Entry submission. By submitting an Entry, the Entrant understands and grants to the Sponsor permission for his/her Entry and other Entrant information to be posted on the Contest Site and other Sponsor properties throughout the world for viewing by visitors to the website and used in accordance with the Official Rules. Sponsor reserves the right to post sample Digital Artwork it has created in connection with the Contest on the Contest Site and other Sponsor properties.
Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant will be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any entry, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof, to Sponsor’s satisfaction, of being the authorized account holder.
ENTRIES POSTED TO THE WEBSITE ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER.
All Entries must comply with the following minimum guidelines to be eligible:
- Digital Artwork and Artist Statement cannot contain content that is irrelevant to the purpose of the Contest.
- Digital Artwork and Artist Statement cannot be profane, pornographic, sexually explicit or suggestive or contain nudity.
- Digital Artwork and Artist Statement cannot be violent or promote firearms/weapons.
- Digital Artwork and Artist Statement cannot promote alcohol, illegal drugs or tobacco.
- Digital Artwork and Artist Statement cannot defame, misrepresent or contain disparaging remarks about people, brands, products or companies.
- Digital Artwork and Artist Statement cannot be obscene or offensive, endorse any form of hate or hate group or be derogatory to any ethic, racial, gender, religious, professional or age group.
- Digital Artwork and Artist Statement cannot reference or contain materials embodying copyrighted images, names, likenesses or other indicia identifying any brand, products, company or person, living or dead, without permission.
- Digital Artwork and Artist Statement cannot communicate messages or images inconsistent with the positive images and/or goodwill to which the Sponsor wishes to associate.
- Digital Artwork and Artist Statement cannot depict illegal activity and cannot itself be in violation of any law.
- Digital Artwork and Artist Statement cannot in any way reference persons or organizations without written permission from any person or organization whose name or likeness is used.
- Digital Artwork and Artist Statement may not include images of a known celebrity, famous or well-known person or any image which violates the right of privacy or publicity of any person.
Sponsor reserves the right in its sole and absolute discretion to reject, disqualify and/or remove any Entries that violate these Official Rules without any notification or warning.
By submitting an Entry, Entrant (or parent/legal guardian if potential Winner is deemed a minor in his/her state of residence) warrants and represents that: (a) it is the Entrant’s original work and has been legally created; (b) it has not been previously published or distributed in any media; (c) it has not been entered in or won previous contests or awards; (d) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity; (e) that Entrant has obtained written permission from any person whose name or likeness is used in the Entry (“Participant”); if a Participant is a minor, written permission must be granted by the Participant’s parent/legal guardian. Participants, or the parent/legal guardian of Participant, must transfer all rights for usage to the Sponsor if and as requested; (f) Entrant owns all rights to the Entry, including without limitation, copyrights, and has received prior written permission from the photographer if any photo was photographed by someone other than the Entrant him/herself; (g) publication of the Entry via various media, including posting on the Contest Site, will not infringe on any third-party rights; and (h) Entrant will indemnify and hold harmless the Sponsor, Contest Administrator and related entities, agents and assigns from any claims and damages (including reasonable attorneys' fees) arising from or relating to the breach or alleged breach of your representations and warranties herein, the Entry, or Entrant’s conduct in creating the Entry, the acceptance or use of any prize or otherwise in connection with this Contest. Sponsor reserves the right to remove, reject or disqualify (along with the Entrants who submitted them) any Entry which, in its opinion violates any of these Official Rules or is otherwise inappropriate.
Sponsor reserves the right to request proof of written permissions from Participants and photographers. By submitting an Entry, Entrant warrants and represents that he/she and any Participants appearing or who are otherwise identifiable in the Entry consents to the submission and the use of the Entry. By submitting an Entry, you understand and grant to the Sponsor, and to its licensees, successors and assigns, and any person or entity acting on its behalf: (a) permission for your name, photo, hometown, school, Digital Artwork, Artist Statement and other entrant information for future advertising and publicity purposes in any and all media without additional compensation, notification or permission; and (b) the irrevocable right and license to use, publish, exploit, modify, edit, transmit and distribute the Entry, including the Digital Artwork and Artist Statement, including without limitation, the names and likeness of any persons or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity for Sponsor’s advertising, promotion or commercial purposes without compensation, permission or notification. Participants retain ownership of their submissions.
By entering this Contest, Entrant grants Sponsor the right to edit, adapt, and publish any or all Entries. The Sponsor will attribute entries and when using these Entries in any media form or in any manner to the best of the sponsors ability but will not provide any additional compensation. Entries made by any other individual or entity that is not the person named on the submitted Entry or made in any manner inconsistent with these Official Rules will be declared invalid and disqualified from this Contest.
PUBLIC VOTING: Beginning at 12:00:01 AM on Tuesday, July 1, 2014 and ending at 11:59:59 PM on Thursday, July 31, 2014 (the “Public Voting Phase”), Entries will be posted to the Contest Gallery. During the Public Voting Phase, individuals who are legal residents of the 50 United States including the District of Columbia and who are 17 years of age or older may access the Contest Gallery and cast one (1) vote per day for one (1) Entry that he or she believes represents the best artistic work.
Employees of the Sponsor are not eligible to vote. Limit: One (1) vote per person per email address per day during the Public Voting Phase. An Entrant may vote for his/her own Entry.
To vote, visit www.LGUSA.com/LGSupportsTheArts and view the Contest Gallery. Upon deciding which Entry you believe represents the best artistic work, click the “Vote” button associated with that Entry and follow all instructions to submit your vote (the “Vote”). The first time you submit a Vote, you will be prompted to verify your email address via email or via Facebook Connect as described below (the “Email Verification”).
- If you choose to verify your email address via email, you will be requested to enter your
email address and an email will be sent to your submitted email address. You must follow
the link as instructed to complete the Email Verification.
- If you choose to verify your email address via Facebook Connect, you will be required to
login to Facebook and authorize the Contest application to complete the Email
Any attempt to gain votes by promising a benefit to the voter, including sites such as Vote Exchange or other similar social media sites, subject the Entrant to disqualification in the sole discretion of the Sponsor. Entrants and/or Voters who spam or create extra email addresses for the purpose of casting votes will have their votes disqualified and their Entry/Vote may be voided. Decisions of the Sponsor are final relating to all aspects of the online voting process and results. The Sponsor may disqualify any Contest Entry, Entrant, or participant(s) submitting a Vote (“the Voter”) if Entrant, Voter or related parties violate any of the terms and conditions attached to the Contest or these Official Rules.
At the conclusion of the Public Voting Phase, the eligible Votes received for each Entrant will be counted. The top 10% of Entries receiving votes will be assigned 15 out of 15 points towards the Finalist Determination, the top 11-50% of the Entries receiving votes will be assigned 10 out of 15 points towards the Finalist Determination and the remaining Entries will receive 5 out of 15 points towards the Finalist Determination. Such score will comprise of 15% of the score for Finalist Determination.
JUDGING: All eligible Entries received during the Contest Entry Phase will be judged and scored by two (2) judging panels: LG Representatives Panel (the “LG Panel”) and Art Authority Panel (the “Art Authority Panel”). Judging will begin on/around Friday, August 1, 2014 and be completed on/around Sunday, August 10, 2014 (the “Judging Phase”).
LG Panel Scoring:
- The LG Panel of judges will judge and score the OLED 1080p Motion Entries based on the following criteria:
- Visual excellence of Digital Artwork on OLED TV Showing Color and Contrast (0 to 33 points)
- Originality (0 to 11 points)
- Creativity (0 to 11 points)
- The LG Panel of judges will judge and score the UHD 4K Digital Still and UHD 4K Motion Entries based on the following criteria:
- Visual excellence of Digital Artwork on UHD TV showing clarity and detail (0 to 33 points)
- Originality (0 to 11 points)
- Creativity (0 to 11 points)
Art Panel Scoring:
- The Art Panel of judges will judge and score the OLED 1080p Motion Entries based on the following criteria:
- Visual excellence of Digital Artwork on OLED TV Showing Color and Contrast (0 to 18 points)
- Originality (0 to 6 points)
- Creativity (0 to 6 points)
- The Art Panel of judges will judge and score the UHD 4K Digital Still and UHD 4K Motion Entries based on the following criteria:
- Visual excellence of Digital Artwork on UHD TV showing clarity and detail (0 to 18 points)
- Originality (0 to 6 points)
- Creativity (0 to 6 points)
FINALIST & WINNER DETERMINATION: At the conclusion of the Public Voting Phase and Judging Phase, the Contest Administrator will take into consideration the scores each Entrant received in the Judging Phase and the number of points each Entrant received in the Public Voting Phase. The following weights will be assigned to the Judging Scores and Public Voting Points: LG Panel Scores—55%; Art Panel Scores—30%; Public Voting Points—15%.
One (1) Entrant from each participating school who receives the highest overall score will be deemed a potential Contest Finalists (the “Finalists”).
The Entrant/Finalist who received the second-highest overall score will be deemed the potential Second Prize Winner.
The Entrant/Finalist who received the highest overall score will be deemed the potential Grand Prize Winner.
In the event of a tie, the tied Finalist with the highest score in Criterion A, Visual excellence of Digital Artwork, will be used to determine the winner. If additional tie-breakers are needed, the tie-breaking mechanism above will be used; however, instead of the highest score in Criterion A determining the winner, the highest scores in each of Criterion B through Criterion C in sequence (to the extent needed) will be determine the winner. If additional tie breakers are needed to determine the Grand Prize winner, the Finalist who received the highest Art Authority Judging Panel Scores will be used to determine the Winner.
FINALIST PRIZES/APPROXIMATE RETAIL VALUE: Each of the Finalists, no more than ten (10), will each receive a Finalist Prize of $5,000 cash and a trip for two (2) to New York City, New York for the Winner Announcement Event that will take place between September 16, 2014 and September 18, 2014. The trip portion of the Finalist Prize includes round-trip, coach airfare for two (2), winner and guest, to New York City, New York from a major airport nearest winner’s residence as determined by the Sponsor; three (3) days and two (2) nights hotel accommodations based on double occupancy at a hotel of the Sponsor’s choice; and a $100 per day cash allowance for meals and incidental expenditures. The total ARV of each Finalist Prize is $7,300.
Trip must be taken on dates specified by the Sponsor or the Finalist Prize will be forfeited in its entirety.
SECOND AND GRAND PRIZES/APPROXIMATE RETAIL VALUE:
- The Second Prize winner will receive $3,000 cash. The total ARV of the Second Prize: $3,000.
- The Grand Prize winner will receive $5,000 cash. The total ARV of the Grand Prize: $5,000.
The Participating School the Second Prize winner was enrolled at the time he/she submitted the Second Prize winning Entry will receive a $25,000 grant to be used towards digital art and technology programs at the Participating School. The Participating School the Grand Prize winner was enrolled at the time he/she submitted the Grand Prize winning Entry will receive a $50,000 grant to be used towards digital art and technology programs at the Participating School. Grants may be subject to additional terms and conditions to be provided by Sponsor at time of award.
SCHOOL GRANT: At the end of the Voting Period, the eligible Votes received for each Entrant will be counted and combined with all other eligible Votes received for all Entrants for each Participating School. The Participating School whose combined Entrants receive the most eligible Votes will receive a $25,000 grant to be used towards digital art and technology programs at the Participating School. Grants may be subject to additional terms and conditions to be provided by Sponsor at time of award.
FINALIST NOTIFICATION & VERIFICATION: On or about August 20, 2014, each Finalist will be notified via email and/or phone and will be required to sign and return, within seven (7) days of notification, an Affidavit of Eligibility, a Liability Waiver, a W-9 Form and where allowable, a Publicity Release (collectively, "the Releases"). These Releases will require the Finalist to furnish his/her Social Security Number for the sole purpose of tax reporting, as required by law. Travel companion of winner will also be required to sign a travel liability waiver. Finalist must be available to travel to New York City, New York for the Winner Announcement Event to be eligible to win the Second or Grand Prize. Noncompliance will result in disqualification and the Entrant with the next highest overall score may be deemed a Finalist.
If a Finalist is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the Finalist Prize will be awarded in the name of winner's parent or legal guardian who will be required to execute and return Releases on minor’s behalf. If Releases are returned as undeliverable or if the selected Finalist cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and the Entrant with the next highest overall score may be deemed a Finalist.
SECOND PRIZE & GRAND PRIZE WINNER VERIFICATION: The Second Prize and Grand Prize winners will be required to sign and return, within three (3) days of notification, the Releases. These Releases will require the winners to furnish his/her Social Security Number for the sole purpose of tax reporting, as required by law. Noncompliance will result in disqualification and the Finalist with the next highest overall score will be deemed the winner.
If the Second Prize or Grand Prize winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the Prize will be awarded in the name of winner's parent or legal guardian who will be required to execute and return Affidavit/Release on minor’s behalf. If Affidavit/Release is returned as undeliverable or if the selected Finalist cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and the Entrant with the next highest overall score will be deemed a Finalist.
PRIZE CONDITIONS: All travel related expenses, including but not limited to, ground transportation to and from home, taxes, gratuities, incidentals, upgrades, insurance, service charges, airport surcharges, departure taxes, hotel, resort or property fees, food & beverage and personal expenses such as telephone/Internet charges, and gift shop purchases are the sole responsibility of prize winner. Each Finalist and his/her travel companion must travel on same itinerary. Each Finalist and his/her travel companion must have valid photo ID and any other documentation required for travel prior to departure. Trip portion of Finalist Prizes must be used on dates specified or prize will be forfeited. Dates are subject to change.
Travel is subject to availability and trip is only available from September 15, 2014 through September 18, 2014.
All hotel reservations are based on availability. Accommodations are subject to availability at time of reservation. Blackout dates, advance booking requirements and travel restrictions may apply. Availability is subject to factors such as weather, seasonality and space availability. Reservations are subject to availability. If weather affects the ability for Finalist and his/her guest to redeem any portion of prize during the scheduled date and time, then the Sponsor shall have no further obligation to the Finalist and/or guest other than to supply the remaining elements of the prize package minus the unused portion of prize. If for any reason whatsoever, Finalist and/or guests are unable to travel after all travel arrangements have been made and paid, the Sponsor shall have no further obligation to the Finalist. If Finalist Prize is forfeited prior to Sponsor finalizing and paying for travel, and there is sufficient time to notify an alternate Finalist, the Finalist prize will be awarded to an alternate Entrant who received the next highest overall score. Finalists and guests are responsible for obtaining the proper travel documentation (e.g., valid photo ID) prior to travel. Finalist’s guest must be legal U.S. resident, over the age of majority in his or her state of residence and must complete and return a Liability/Publicity/Travel Release prior to travel as noted above. If Finalist is under the age of majority in his/her state of residence, the Finalist’s guest must be his/her parent, legal guardian.
In the event that a Finalist or his/her guest engage in behavior that, as determined by the Sponsor and in its sole discretion, is obnoxious or threatening, illegal, or that is intended to annoy, abuse, threaten or harass any other person, the Sponsor reserves the right to terminate the trip prize in whole or in part, with no further compensation.
If a prize notification or prize is returned as undeliverable, or if Finalist/Grand Prize winner is found to be ineligible or not in compliance with these rules that Finalist/Grand Prize winner will be disqualified, and the prize may be awarded to an alternate Finalist/Winner.
Prizes are not redeemable for cash. Prizes are non-assignable or transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No cash in lieu of prizes and no exchange or substitution of prizes, except at the sole discretion of the Sponsor.Any other incidental expenses on prize not specified herein are the winner’s sole responsibility.
Finalists and Winners are responsible for all federal, state, local and income taxes associated with winning prize. Finalists and Grand Prize Winner will be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law. Except where prohibited by law, entry and acceptance of prize constitute permission to use winner's name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.
No confidential relationship is established by any Entrant and the Sponsor as a result of entering the Contest. None of the information submitted by the Entrant will be treated as trade secrets, confidential information or as protected data under any obligation. No patent, copyright or other intellectual property rights or licenses are granted to any Contest components supplied by the Sponsor to the potential Entrants. Potential Entrants do not receive by way of or under the Contest any intellectual property or other rights in any copyrights, patents, trademarks, trade names, technology, trade secrets or know-how of either the Sponsor or any third party.
Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners acknowledge that the Official Sponsor and all other businesses affiliated with this Contest and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative the quality, conditions, fitness or merchantability of any aspect of the prize being offered, except that each merchandise prize shall be subject to its manufacturer’s standard warranty (if any).
GENERAL: Although subsequent attempts to enter may be received, only the first complete entry received from a particular entrant will be eligible; subsequent attempts by the same person to enter, including entries submitted with an alternate email address, will be disqualified.
In the event any entrant, voter, finalist or winner engages in behavior that (as determined by Sponsor in Sponsor's sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten, disparage or harass any other person or company related to the contest or deemed by the Sponsor to be threatening, disparaging or damaging to the Sponsor, the Sponsor reserves the right to disqualify the entrant, voter or winner and void any entries or votes made by said person.
Entries/Votes, with the exception of Digital Artwork as described in the How To Enter section above, become sole property of Sponsor and none will be acknowledged or returned. Nothing in these official Contest rules shall obligate Sponsor to publish or otherwise disclose any entry/vote submitted in connection with this Contest. Entrants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Contest.
Incomplete, corrupted or untimely Entries or Votes; or any Entry/Votes generated by a script, macro or other automated means are void and will be disqualified. Sponsor and its agencies are not responsible for incomplete, corrupted or untimely Entries/Votes or for incomplete, lost, interrupted or unavailable network, server or other connections, miscommunications, computer or software malfunctions or telephone transmission problems or technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind whether human, mechanical, electronic or otherwise. Proof of sending an entry will not be deemed to be proof of receipt by Sponsor.
If, for any reason, the Contest is not capable of being conducted as planned, including but not limited to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures or other causes beyond the control of Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Sponsor also reserves the right in its sole discretion to disqualify any individual found to be violating these Official Rules or suspected of attempting to disrupt or defraud the Entry or voting process or the operation of the Contest, and Sponsor may prosecute or seek other legal redress against anyone suspected of engaging in these acts. Sponsor reserves the right to disqualify any Entry or Vote at any time during the Contest Period that may be found ineligible.
Sponsor is not responsible if the Contest cannot be implemented or prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism. All federal, state, local and municipal laws and regulations apply.
Participating entrants agree to these Official Rules and the decisions of US Sweepstakes & Fulfillment Co. and the Sponsor, and release the Sponsor and their affiliated companies, and all other businesses involved in this Contest, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation in the Contest, and the acceptance and use/misuse of any prize offered. Finalists/Grand Prize Winner assume all liability for any injury or damage caused or claimed to be caused, by participation in this Contest or use/misuse or redemption of the prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes.
In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or potential winner to provide Sponsor with proof that such party is the authorized account holder of the email address associated with the entry. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Contest. By participating in the Contest, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the independent contest administrator, which are final and binding in all matters relating to the Contest. Failure to comply with these official rules may result in disqualification from the Contest. Sponsor reserves the right to: (i) permanently disqualify from any Contest it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Contest), and to determine winners from among all eligible entries received prior to withdrawal.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New York. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
PRIVACY: By entering and providing the required entry information, Entrants acknowledge that the Sponsor may also send information, samples or special offers it believes may be of interest to Entrant, or other information or goods offered by its marketing partners.
